Terms of Service

1. Who we are and what these Terms cover
These Terms of Service ("Terms") govern the use of the developer area of madoctopus.fun - the "Dev Hub", including bundle matchmaking, match chat, generated bundle materials ("Bundle Kit") and optional hands-on services ("Services") - operated by Piotr Karbowski, doing business as Mad Octopus, Poland ("Operator", "we"). Contact: info@madoctopus.fun. By creating an account, requesting a sign-in link or using the Dev Hub you accept these Terms.
2. Business users only
The Dev Hub is offered exclusively to game developers, studios and publishers acting for purposes related to their trade, business or profession (B2B). It is not directed at, and may not be used by, consumers within the meaning of Article 22¹ of the Polish Civil Code. By using the Dev Hub you represent that you act as a business user.
3. Service "as is", no guarantees
The Dev Hub is provided on an "as is" and "as available" basis, whether accessed on the Free Plan or the Paid Plan (Section 10). To the maximum extent permitted by law we exclude all warranties, express or implied. We do not guarantee availability, error-free operation, data retention, or that any feature will remain unchanged or continue to exist. We may modify, suspend or discontinue any part of the Dev Hub at any time. Statutory warranty for defects (rękojmia) is excluded to the extent permitted in business-to-business relations.
4. Accounts and access
You can create an account yourself on the Free Plan (subject to the bundle-slot commitment in Section 6) or the Paid Plan (Section 10). Sign-in uses one-time links sent by email and, optionally, a password you set in your Profile. You are responsible for the security of your mailbox and for all activity under your account. Accounts are personal to one studio/business and may not be shared or transferred. We may refuse, suspend or terminate any account at our sole discretion, particularly for a breach of these Terms.
5. Your games and content
By submitting a game you represent and warrant that you hold all rights to that game and its store assets, or are duly authorised to act for the rightsholder. You retain all rights to your games. You grant the Operator a non-exclusive, worldwide, royalty-free licence to display your game's publicly available Steam store data and artwork within the Dev Hub and to create composite bundle materials from official store assets (yours and your match partner's) for the purpose of providing the Bundle Kit. Every submission is subject to manual review; we may reject or remove any game without stating reasons.
6. Free Plan: bundle-slot commitment
If you use the Dev Hub on the Free Plan, then in consideration for free access you grant the Operator the right to place and keep one (1) Mad Octopus bundle in one of the top three (3) bundle slots on the Steam store page of each game you add to the Dev Hub (the "Slot Commitment"). In particular: (a) the commitment covers one slot per game at a time and only bundles created or co-created by the Operator; (b) because bundle placement is managed in Steamworks by you, you agree to carry out the reasonable technical steps we request (such as creating a bundle or accepting a bundle invitation in Steamworks) within 14 days of our request; (c) the Slot Commitment applies for as long as the game is listed in the Dev Hub under a Free Plan account, and bundles created during that time may remain live afterwards; (d) you may end the Slot Commitment for the future at any time by switching to the Paid Plan (Section 10) or deleting your account - this does not affect bundles already live; (e) the Slot Commitment is non-exclusive and free of charge in both directions; revenue from bundle sales is settled by Valve separately for each product under Steamworks rules, so revenue from your game always goes to you.
7. Matchmaking and the Bundle Kit are tools, not advice
The Dev Hub connects developers; the Operator is not a party to, nor a broker of, any agreement between matched developers. We do not guarantee matches, replies, concluded bundles, sales, wishlists or any commercial outcome. Fit scores, suggested discounts, description drafts, launch windows and generated graphics are automated suggestions provided for convenience only and do not constitute legal, tax or business advice. You are solely responsible for your bundle agreements, Steamworks configuration, pricing and compliance with Steam's rules.
8. Chat and conduct
Match chat may be used solely to discuss potential cooperation between the matched studios. Spam, harassment, unlawful content, soliciting unrelated services and automated scraping are prohibited. We may access chat content for moderation, abuse prevention and legal compliance, and may remove content or suspend accounts that breach this section.
9. Services (audits, key campaigns, playtests, publishing applications)
Service requests submitted through the Dev Hub are invitations to negotiate; a contract is concluded only when we expressly confirm scope, price and timeline. Unless expressly agreed otherwise in writing, Services are provided with due care as obligations of means (umowa starannego działania), not obligations of result - we do not warrant any specific outcome (including coverage, reviews or sales). Steam keys you provide for campaigns remain your property and responsibility; we are not liable for how third-party creators use or fail to use them. Deliverables are for your internal business use.
10. Plans and fees
The Dev Hub offers two access plans: the Free Plan - free of charge, subject to the Slot Commitment described in Section 6 - and the Paid Plan - a one-time access fee in the amount shown at checkout, with no Slot Commitment. The one-time fee grants access for as long as the Dev Hub operates and, once access has been granted, is non-refundable to the extent permitted in business-to-business relations. Paid Services under Section 9 are quoted and agreed individually. We may introduce or change paid features in the future; prices and conditions will be communicated in advance and will apply only after you accept them.
11. Liability
To the maximum extent permitted by Polish law, in relations with business users: (a) we are liable only for damage caused intentionally (Article 473 § 2 of the Civil Code); (b) we are not liable for lost profits, lost data, business interruption or any indirect or consequential damage; (c) our total aggregate liability arising out of or in connection with the Dev Hub is limited to the higher of the fees you paid us in the 12 months preceding the event or PLN 500. Nothing in these Terms limits liability that cannot be limited under mandatory law.
12. Indemnity
You will indemnify and hold the Operator harmless from any third-party claims, damages and reasonable costs (including legal fees) arising from your breach of these Terms, in particular from submitting a game you were not authorised to submit or from content you post in the Dev Hub.
13. Personal data
Processing of personal data is described in our Privacy Policy. In short: we process your email, studio profile, game data, swipe decisions, match chat and service requests to operate the Dev Hub. Match partners see your contact email and studio profile after a mutual match - that disclosure is the point of the service.
14. Third parties
Steam and the Steam logo are trademarks of Valve Corporation. The Dev Hub uses publicly available Steam store data and artwork and is not affiliated with, endorsed or sponsored by Valve. Your use of Steamworks remains subject to Valve's own terms.
15. Changes, termination, final provisions
We may amend these Terms; material changes will be announced in the Dev Hub or by email at least 7 days in advance, and continued use after that date constitutes acceptance. You may stop using the Dev Hub and delete your account at any time in the Profile tab. These Terms are governed by Polish law; any disputes will be resolved by the common court having jurisdiction over the Operator's registered seat. If any provision is held invalid, the remainder stays in force. The English text is the binding version.
